Commonwealth Court Sides with McLinko, Tosses Out Act 77

The Commonwealth Court of PA today issued a ruling that Act 77, which established no-excuse mail-in voting, is unconstitutional.

In its opinion, the court said it was not expressing a view on whether or not there should be no-excuse mail-in voting in PA.

However, the court stated that for no-excuse mail-in voting to occur in PA, it must first be authorized by an amendment to the state’s Constitution.
